Terms of Service

Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the Capacity Tracker mobile application (the "App") operated by 1AM Studios LLC ("us," "we," or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.

2. Description of Service

Capacity Tracker is a mobile application designed to help users count and track occupancy and capacity at various locations. The App allows users to:

  • Count people entering and exiting a location
  • Set maximum capacity limits with visual alerts
  • Save and manage multiple locations
  • View counting history
  • Sync data across devices (with an account)

3. User Accounts

Some features of the App require you to create an account using third-party authentication services (Google Sign-In or Apple Sign-In). When you create an account:

  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to infringe on intellectual property rights
  • Transmit viruses or malicious code
  • Harass, abuse, or harm others through use of the App

5. Advertisements

The App displays advertisements from third-party ad networks. By using the App, you agree to:

  • View advertisements as part of the App experience
  • The collection and use of data by ad networks as described in our Privacy Policy

You may remove advertisements by watching rewarded video ads when available.

6. Intellectual Property

The App and its original content, features, and functionality are owned by 1AM Studios LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of the data you enter into the App. By using the App, you grant us a license to store, process, and display your data as necessary to provide the service.

7. Third-Party Services

The App may contain links to or integrate with third-party services, including:

  • Authentication providers (Google, Apple)
  • Cloud storage services (Firebase)
  • Advertising networks
  • Analytics services

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • The results obtained from using the App will be accurate

The App is intended as a tool to assist with counting and should not be relied upon as the sole method for safety-critical capacity management.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1AM STUDIOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits or revenue
  • Loss of data
  • Loss of business opportunities
  • Personal injury or property damage

In no event shall our total liability exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is less.

10. Indemnification

You agree to indemnify and hold harmless 1AM Studios LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the App ceases immediately
  • You may lose access to data stored in your account
  • Provisions that should survive termination will remain in effect

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

  • Posting the new Terms in the App
  • Updating the "Last updated" date
  • Sending notification through the App (for material changes)

Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Texas.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1AM Studios LLC regarding the use of the App.
